These Terms of Service ("Terms") govern your use of the Thoughtcrime website and services. By using our services, you agree to these Terms.

1. Services

Thoughtcrime (a trading name of Trend IT OÜ, Estonia) provides:

• Privacy and security hardware products
• Pre-configured turn-key solutions
• IT security education and training
• Digital asset security education (separate agreement required)

Specific services are governed by individual service agreements signed before engagement.

2. Not Financial Advice

3. Eligibility

You may not use our services if you:

• Are under 18 years of age
• Are located in a sanctioned or embargoed jurisdiction
• Are prohibited by applicable law from receiving our services
• Have been previously terminated from our services

4. Your Responsibilities

When using our services, you agree to:

• Provide accurate and complete information
• Maintain the security of any credentials you create
• Use our services only for lawful purposes
• Not attempt to circumvent any security measures
• Not use our services to harm others or engage in illegal activity

5. Intellectual Property

All content on this website, including text, graphics, guides, and training materials, is owned by Thoughtcrime or our licensors. You may not reproduce, distribute, or create derivative works without permission.

Documentation provided during services is licensed for your personal use only and may not be shared or resold.

6. Hardware Products

For hardware purchases:

• Products are sourced from authorized distributors
• Manufacturer warranties apply where available
• Returns are subject to our return policy in the Hardware Sales Agreement
• We do not pre-install cryptocurrency wallets or retain any access to devices

7. Turn-Key Solutions

For pre-configured systems:

• You must complete final security setup (passwords, encryption keys)
• We have zero access to your devices after handover
• Lost credentials cannot be recovered by us
• A Device Handover Checklist must be signed at delivery

8. Education Services

For training and consulting:

• You operate your own devices; we provide guidance
• We do not set, know, or retain your passwords or keys
• Information is educational and does not guarantee security
• Follow-up support is limited as specified in your agreement

9. Payment

• Fees are specified in individual service agreements
• Payment is due as specified (typically in advance or upon completion)
• Prices are in EUR and exclude VAT unless stated otherwise
• Late payments may incur interest as permitted by law

10. Limitation of Liability

To the maximum extent permitted by law:

• Our total liability is limited to fees paid for the specific service
• We are not liable for indirect, consequential, or punitive damages
• We are not liable for loss of cryptocurrency or digital assets
• We are not liable for forgotten passwords or lost encryption keys
• We are not liable for third-party products or services

11. Indemnification

You agree to indemnify and hold harmless Thoughtcrime from any claims, damages, or expenses arising from your use of our services, violation of these Terms, or violation of any third-party rights.

12. Termination

We may terminate or suspend your access to our services at our discretion if you violate these Terms or for any other reason with reasonable notice. Provisions that should survive termination (liability, indemnification, etc.) will remain in effect.

13. Governing Law

These Terms are governed by the laws of the Republic of Estonia. Disputes shall be resolved through the courts of Harju County, Estonia, or through arbitration under the Rules of the Arbitration Court of the Estonian Chamber of Commerce and Industry.

14. Changes

We may update these Terms periodically. Continued use of our services after changes constitutes acceptance. Material changes will be communicated via email or website notice.

15. Severability

If any provision of these Terms is found unenforceable, the remaining provisions continue in full force.
